I want to thank all of our speakers today and all of the attendees—the great thought leaders here in the intellectual property rights field.

Today we have a great opportunity to hear from U.S. and Chinese leaders in the Intellectual Property Rights field.

I am especially pleased that Chairman Liu of the Education, Science, Culture, and Public Health Committee of the National People’s Congress, has been able to take time out of his busy schedule to speak with us today – so thank you Chairman Liu. Not just for speaking with us today, but for your incredible leadership on IPR protection and enforcement all these years. Let’s give Chairman Liu a big round of applause.

I also want to thank several Chinese government officials for attending this luncheon and also for participating in our forum this afternoon. We have Deputy Director General Chai of the Office of IPR Leading Group, Ministry of Commerce; Director General Yu of the National Copyright Administration of China; and Deputy Director General Yang of the Office of Treaty and Law of the Ministry of Commerce.

We established the Ambassador’s Intellectual Property Roundtable 11 years ago. It has since become a cornerstone for U.S.-China dialogue on intellectual property rights protection and enforcement.

The Roundtable has grown to include direct conversations between Chinese and American thought leaders, innovators on how China and the United States can work together to further enhance China’s Intellectual Property Rights systems for the benefit of innovators and consumers, not just in China, but around the world.

The great thing about this annual Roundtable is that the direct conversations we start here today will continue into the future.

Though we have many differences, our willingness to come together to resolve those differences means that we can find solutions that work for both sides.

A truly innovation-based economy requires protection of intellectual property rights through effective and vigorous enforcement mechanisms, because for a right to be truly a right, for a right to be truly an asset—it can only happen if that right can be protected and the rights holder has confidence in the ability to enforce it.

And this confidence can only be gained by ensuring strong commercial rule of law.

I’m a lawyer by training, actually a former criminal prosecutor. But I’ve also been a governor of the state of Washington, Secretary of Commerce, and now U.S. Ambassador to China. And all throughout those posts, the importance of commercial rule of law has become even more clear, every single day.

There must be an appropriate and transparent legal regime. Companies must have access to complete and clear laws and rules that govern them.

Those laws and rules must be fair and balanced, and provide a legal framework that companies can understand and apply.

Commercial rule of law is not a single concept; instead it encompasses numerous components that must function together.
商業法治不是一個單一概念,相反它包含無數必須共同作用的組成部分。

Civil and criminal enforcement mechanisms must guarantee transparency before, during and after a trial.
民事和刑事強制執行機制必須確保庭審之前,期間和之後的透明度。

All litigants must be permitted to participate equally and to support their side of the argument without overly burdensome procedural rules. And there must be consistency in application of procedural remedies, especially pre-trial remedies. And trial outcomes must compensate right holders fairly and deter future infringers.
所有訴訟當事人都必須得到允許來平等地參與並支持自己一方的論點,不受過度繁瑣的程序規則限制。程序性補救措施的適用必須有一致性,特別是庭審前補救措施。庭審結果必須公平地補償權利人並遏制未來的侵權者。China has updated much of its IPR framework since Joining to the World Trade Organization some 12 years ago. This includes recent, important amendments to its trademark law earlier this year.

China also recently revised its Civil Procedure Law to provide right holders access to pre-trial procedural tools, which will help halt infringements before they cause significant harm and this will also facilitate the gathering of evidence before it is destroyed or concealed.

China’s enforcement regimes are clearly moving in the right direction. And there are more developments in China’s Intellectual Property Rights landscape every single month.

But our work is far from complete. For instance, the need for reform is perhaps greatest in the area of trade secrets law, which has remained unchanged since 1993. And we continue to hear from Intellectual Property Rights holders that proceedings in China lack transparency.

Rights holders, including many Chinese, have told us that they were unable to present their side of a dispute, that courts lack consistency in the application of procedural remedies, and that damages awarded do not fully compensate for losses or fail to deter future infringers.

There is still a long road ahead before right holders in China can feel confident that their IPR will be both fully protected under the law and effectively enforced.

Just a few weeks ago when I spoke at the U.S.-China Film Forum in Beijing, I met a Chinese entrepreneur involved in the distribution of licensed television and movie content on the Internet.

He said his business is struggling to compete in a market where over 90% of the content is illegally distributed.

Here is a situation where you have a talented entrepreneur trying to bring legitimate content to Chinese consumers, but at every turn, his efforts are undermined by less scrupulous individuals.

So long as such entrepreneurs’ efforts go unrewarded, China’s efforts to develop an innovative, 21st Century economy will remain stunted.

To ensure China’s continued development and therefore development of the global economy, we need to expand and deepen our shared efforts to strengthen commercial rule of law.

Collaboration between our governments, our academic institutions, our courts, our companies, is more essential now than ever before.

There are already numerous examples of where this type of candid collaboration has begun, however.

·We have seen improved cooperation between U.S. Homeland Security investigators and Chinese Customs and Public Security officers.

·We are engaging on difficult issues with the working office of China’s National IPR Leading Group, on difficult issues, including the protection of trade secrets.

·And just two weeks ago, China’s Supreme People’s Court published a report advocating greater independence by and transparency within the judiciary. This report shows that Chinese legal experts themselves are interested in improving China’s commercial rule of law framework.

U.S. and Chinese officials are continually exploring how to strengthen our cooperation on IPR policy and enforcement issues through a variety of bilateral government mechanisms, like the Joint Commission on Commerce and Trade (JCCT) and the Joint Liaison Group (JLG).

What I ask of you today, during your discussions this afternoon, is to identify common ground. Our colleagues holding discussions at the JCCT and the Joint Liaison Group, and elsewhere can benefit from your discussions and your agreements today.

In conclusion, let me just leave you with some impressions of Thomas Edison, one of America’s most famous inventors, who died in 1931.

His creativity was made possible by rigorous IPR protection and enforcement, and commercial rule of law.

Edison’s ability to monetize his inventions because of intellectual property rights made it possible to continue his life of inventiveness, and gave birth to the film and music industry, among many others.

One of Thomas Edison’s most cherished sayings has become an American maxim: “Genius is one percent inspiration and ninety-nine percent perspiration”.

The 99 percent is what we are here to talk about today. We’re committed to supporting entrepreneurs by taking on the hard work of forging strong protection of Intellectual Property Rights and strong commercial rule of law. Without our efforts, the new Edisons, whether they be in China, Latin America, America, or somewhere else, won’t have the chance to realize their genius.
