【背景】
最高人民法院、最高人民檢察院、公安部、司法部、海關總署16日聯合發佈《關於進一步加強國境衛生檢疫工作 依法懲治妨害國境衛生檢疫違法犯罪的意見》。根據這份意見，檢疫傳染病染疫人或者染疫嫌疑人拒絕隔離、不如實填報健康申明卡等，可按妨害國境衛生檢疫罪定罪處罰。

People who do not report truth about their infectious diseases or falsify their health statement cards when entering the country will be identified as disturbing border health and quarantine in accordance with Chinese criminal law.
依據我國刑法，入境時瞞報傳染性疾病、不如實填報健康申明卡者，可按妨害國境衛生檢疫罪定罪處罰。

最高人民法院（the Supreme People's Court）、最高人民檢察院（the Supreme People's Procuratorate）、公安部（Ministry of Public Security）、司法部（Ministry of Justice）、海關總署（Central Administration of Customs）16日聯合印發相關意見，明確這一罪名。
《意見》旨在進一步加強國境新型冠狀病毒（novel coronavirus）的衛生檢疫工作（health and quarantine work），更有效地依法保障公共衛生安全（keep public health secure）。
除僞造健康信息（health information）外，《意見》還明確了依據刑法（in accordance/line with the Criminal Law）認定妨害國境衛生檢疫罪（disturb border health and quarantine）的幾種情形。
舉例來說，拒絕執行海關提出的健康檢查（health checks）、或隔離要求（quarantine orders）的；或來自檢疫傳染病流行國家、地區的出入境交通工具（exit-entry public transport）上出現非意外傷害死亡（non-accidental deaths）且死因不明的人員，交通工具負責人故意隱瞞情況的，將面臨類似的刑事指控（criminal charge）。
《中華人民共和國刑法》第三百三十二條規定：“ 違反國境衛生檢疫規定， 引起檢疫傳染病傳播（cause spread of the infectious disease）或者有傳播嚴重危險的，處三年以下有期徒刑或者拘役（a maximum sentence of three years in prison or detention），並處或者單處罰金（fines）。
