上海將爲消費者提供爲期7天的冷靜期，以解決無良銷售健身房會員資格的問題，以及消費者因衝動購物而面臨的退款困難。

上海市消費者委員會週一發佈《上海市體育健身行業會員服務合同示範文本（sample membership contract for the city's sports and fitness industry）》，以下簡稱《會員服務合同》，旨在規範健身服務經營者（fitness service operators）的經營行爲。
《會員服務合同》聚焦經營者利用格式條款限制消費者權利（using terms that restrict consumers' rights），減輕、逃避自身責任（reduce and avoid their own responsibilities）等問題，以期用規範合同的形式從源頭上化解消費糾紛（resolve consumer disputes）。
首批15個上海主要健身品牌（major fitness brands）400餘家門店率先承諾履行和使用《會員服務合同》，將於2021年1月1日起正式推廣使用。
《會員服務合同》中的一大亮點是特別設置的“七天冷靜期退費”條款，明確消費者在簽署合同次日起的7日內，在未開卡使用會員服務的情況下（purchasers who have not used their membership card），都可以單方面解除合同並獲得全額退款（terminate the contract unilaterally within seven days and get a refund）。
上海市體育局規劃產業處（法規處）處長餘詩平表示，“之所以在合同文本中明確了‘七天冷靜期’，就是想從源頭上處理退卡退費的問題（deal with the problem of withdrawal and refunds from the very beginning），一方面希望消費者在籤合同（sign the contract）之前理性思考（think rationally），另一方面也是希望發揮部門的指導，對於沒有履行好合同的健身企業（fitness enterprises）進行監督。”
根據專業機構對健身行業的調查，2019年，光是上海就有泛健身門店8227家，而在去年一整年裏，上海市12345市民服務熱線（service hotline）受理的健身行業預付費類消費投訴（complaints about prepaid gym memberships）就有15690件。
餘詩平說，“健身行業投訴（fitness industry complaints）在所有投訴裏佔據前三名，而其中最大的投訴類型就是退費問題（refunds）。”
《會員服務合同》明確退卡（費）情形（the situation for refunds），對違約責任（liability for breach of contract）、合同解除作出詳細規定，明確經營者和消費者的權責關係（the rights and responsibilities of operators and consumers）。
針對因經營者違約（the operator breaches the contract），發生擅自變更會員服務內容（changing the service content without authorization）、終止營業、搬遷（terminating or relocating the business）且補償方案未與消費者達成一致（failing to reach an agreement with the consumer on compensation）或未履行補償方案、暫停營業且未履行補償方案等四種情形，消費者有權單方面解除合同並獲得相應退款（the consumer has the right to unilaterally terminate the contract and obtain a refund）。
